What is Careless Driving?
Under the Ontario Highway Traffic Act, careless driving pertains to any individual “driving a motor vehicle without due care and attention, or without a reasonable consideration for other people using the highway.” This leaves a broad description left up to interpretation of a judge.
Penalties of a Careless Driving Conviction
At minimum, a charge for careless driving includes 6 demerit points, a $400 fine and no more than $2,000, possible licence suspension for no more than 2 years and possible imprisonment for up to 6 months.
