Commonly Asked Questions on the RTA

Before you sign a lease or decide to rent out your property, make sure you understand your rights and agreements. Here is a list of the most commonly asked questions regarding tenant and landlord rights.

Can my landlord enter my unit?

Only under specific circumstances. Your landlord must first give 24 hours notice that they will be entering and why they must enter. Some exceptions apply, including an emergency.

How often can my landlord increase rent?

Once every 12 months. A landlord must give a 90 day written notice of the increase in rent.

As a landlord, can I apply for a rent increase above the guidelines?

Yes, but only under certain circumstances including an increase in utilities and after significant renovations.

What can I do if my tenant has not paid rent?

You may give a Notice to End a Tenancy Early for Non-payment of Rent if your tenant has not paid by the due date. This notice requires the tenant to pay rent within 14 days or to move out. If neither of these is the outcome, you may apply for a hearing with the Landlord and Tenant Board.
